Privacy Policy
The Privacy Act 1988 (Cth) (the Act) allows for the personal information to be collected, used and disclosed for the purpose for which it was collected, and otherwise in accordance with the Act. This Privacy Policy applies to the extent, DR2 Pty Ltd, t/a AVANZA Property (known here-within as, the agency), collects, uses and discloses personal information. The agency may amend, or amend and restate, this Privacy Policy from time to time and may subsequently notify a; principal/vendor/tenant/owner/renter/subscriber/client/user of any service and/or information, (the User) of any changes to this Privacy Policy by updating it on the agency website or by other notification to the User or by inclusion in a signed service agreement. Any changes to this Privacy Policy take effect upon the earlier of the update to the website or other notification to the User.
The personal information you (the ‘User’) provides the agency in connection with a service or collected from other sources is necessary for the agency to: (a) identify and verify the User and any related/associated property; (b) advertise and promote a property the agency is authorised to lease or sell; (c) process and assess any application received in relation to a lease or sale of a property under agreement with the agency, including assessing a rental applicant or Tenant’s ability to meet their financial and other obligations of a lease; (d) negotiate and prepare any lease or sale notifications for a property under agreement with the agency; (e) liaise and exchange information with the User and the agency or the User’s legal and other advisors in relation to or in connection with any lease or sale of a property under agreement with the agency; (f) manage, serve and sign (and arrange signing of) an agreement and manage any lease or sale of property under agreement with the agency, including the collection/receipt of rent on behalf of the User and the preparation of required statements of account; (g) comply with any applicable law; (h) confirm whether the User is registered for GST purposes; (i) operate controlled money accounts; (j) comply with any dispute resolution process; and (k) contact and liaise with third parties (including, without limitation, goods and services providers, mortagagees and insurers) and to provide those parties with the User’s personal information.
If the personal information is not provided by the User, the agency may not be able to, act on behalf of, or service, the User effectively or at all. The agency will take reasonable precautions to protect the personal information it holds in relation to the User from misuse, loss, and unauthorised access, modification or disclosure. Personal information collected about the User may be disclosed by the agency for the purpose for which it was collected to other parties including the agency’s or the User’s legal and other advisors, advertising and media organisations, property data service providers, prospective and actual tenants, clients of the agecncy both existing and potential, tradespeople, other industry agents, strata owners corporations, valuers, government and statutory bodies, financial institutions and other third parties (including, without limitation, goods and services providers and insurers) or as required by any applicable law.
The agency may also use the User’s information including personal information for marketing and research purposes to inform the User of products and services provided by the agency, which the agency considers may be of value or interest to the User, unless the User tells the agency or has previously told the agency not to. If the User does not wish to receive any information about such products and services then they may notify the agency using the Contact Us form on its website or use the unsubscribe option if available.
The User has the right to request access to any personal information held by the agency which relates to the User, unless the agency is permitted by law (including the Act) to withhold that information. Any requests for access to the User’s personal information should be made in writing and authorised by the User to the agency to its postal address. The agency may charge a reasonable fee where access to personal information is provided (no fee may be charged for making an application to access personal information). The User has the right to request the correction of any personal information which relates to the User that is inaccurate, incomplete or out-of-date.
By signing any agreement, or by; submitting, signing up, accepting (including cookies), contacting us, attending any inspection, registering for any inspection, or interacting with the agency, lodging an expression of interest, in using any information on this website or information originating from this website, the User acknowledges that it has read, understands and accepts the terms of this Privacy Policy and the permissions to collect, use and disclose personal information, and the User authorises the agency to collect, use and disclose, in accordance with the Act, their personal information for the purposes specified in this Privacy Policy.
